Being that the Justice died now, and the new President successor will not come into office until 2017, logically Obama should try to appoint someone now to fill the vacancy. The Senate can then do it's process of confirming or denying the appointment.
Why it matter if the appointment is halted until a new President assumes power is due to the cases that the Supreme Court decides matters on. If Obama appoints someone, who is confirmed that new justice could have views that are the same as Obama's on controversial issues such as abortion, marriage, etc. etc.
As for the conspiracy theorists, if high level governmental authorities want to whack someone, they put polonium in their tea. Unless it is being looked for, people just assume the person died from the many conditions/symptoms the present with. Oh they had a heart attack, oh they started going downhill, they were old etc. Polonium is how Yasser Arafat was killed, and other high level notable people. Key Republican senators on the Judiciary Committee emerged from a closed door meeting in Majority Leader Mitch McConnell's office Tuesday united in their determination not to consider any nominee to replace Antonin Scalia until the next president takes office.
Tuesday was the first full day the Senate was back in session since Scalia's death Feb. 13.
"We believe the American people need to decide who is going to make this appointment rather than a lame duck president," said Majority Whip John Cornyn (R-TN).
When asked if they would start the process after the new president took office or if they would consider doing it in the lame duck session, Cornyn replied "No, after the next president is selected. That way the American people have a voice in the process."
The Republican members of the Judiciary Commitee were unanimous in agreeing not to move forward with any Obama nominee for the Supreme Court, said Cornyn, who was in the meeting. Sen. Bob Corker (R-TN), who was not in the meeting, later said that GOP senators were told at their weekly lunch that the Judiciary Committee Republicans were in unanimous agreement on the strategy.
Meanwhile, Judiciary Committee Chair Charles Grassley (R-IA) and the rest of the committee Republicans sent a letter to McConnell outlining their plan to block any Obama nominee for Scalia's seat.
Sen. Lindsey Graham (R-SC) said that "there's no use starting a process that's not going to go anywhere and we are going to let the next president decide," when asked why there would be no hearings.
When TPM asked if he had political concerns about the decision not to move forward with a nominee, Graham responded."I have zero concerns politically."
"I think this is what they would do," Graham said referring to Senate Democrats. "For them to say they wouldn't do this is a lie."
Sen. Jeff Flake (R-AZ) demurred saying that Republicans were "still talking."
The meeting in McConnell's office came not long after he made a speech on the Senate floor vowing to block any Obama nominee.
"Presidents have a right to nominate just as the Senate has its constitutional right to provide or withhold consent. In this case, the Senate will withhold it," McConnell said. "The Senate will appropriately revisit the matter after the American people finish making in November the decision they've already started making today."
What if during the next election, when we vote for Congressional and Senate members, we got people on the ballots by referendum who actually represented us? Ross Perot suggested it back in the 90's and that may be what we need to do, to actually get people who will represent WE the people.

Biden was referring to a hypothetical situation, since the Senate was not considering a nominee at the time of his remarks. But the sudden death of Justice Antonin Scalia earlier this month has left a precarious 4-4 ideological balance between right- and left-leaning justices as they consider cases on abortion, voting rights, Obama's health care law and other polarizing issues.
Senate Majority Leader Mitch McConnell, R-Ky., reiterated the stance he took hours after Scalia's death that the next president should select a court nominee. He said Senate Judiciary Committee Chairman Charles Grassley, R-Iowa, whose statements have wavered, agreed with him.
But separately, McConnell's press office and Grassley in a floor speech went further and cited the 1992 Biden remarks. Grassley called the comments "The Biden Rules" and said the vice president "knows what the Senate should do."

"I also recognize my duty as a senator to either vote in support or opposition to that nominee following a fair and thorough hearing along with a complete and transparent release of all requested information," Kirk wrote.
Sen. Susan Collins, R-Maine, said she favored Judiciary Committee hearings "so that there can be an in-depth vetting of the nominee and his or her views." Several other GOP senators said they'd defer to a decision by Grassley about holding hearings, including Sens. Richard Burr, R-N.C., Rob Portman, R-Ohio and Ron Johnson, R-Wis., who face re-election contests in November.

Somebody educate me on something. Since when did Kennedy become a conservative on the court? I thought he was typically a swing vote. I hear him getting grouped with conservatives saying there were 5 judges on the right and 4 on the left. I thought it was more appropriately 4 right, 4 left and Kennedy in the middle most often.
If that is in fact true the stakes are very high for those on the right. A 3 right, 5 left and 1 in the middle doesn't look very good to him.

Just words, there was no SCOTUS opening when he said them so meaningless in any practical sense. But if you are saying Biden was right, then where do you draw the line? The "political season" was underway this time last year, and was already in full swing and at fever pitch by May/June of last year.
In any case, as Bhawk already pointed out early on in this thread, there are plenty of flip-flop statements from both sides from over the years that all hinge on the political landscape of the time. For example...

Hey Nebish I think Kennedy is considered a conservative because he was appointed by Reagan. Truth is no one really knows how the Justices will vote once they get their lifetime appointment. To me how you described your "organization" meeting with other NGOs, the CDC and WHO is this was a either a meeting about a grant proposal, a general funding meeting or a seminar for already funded agencies. I don't think you have a very healthy attitude for someone attached to the government udder. Out of habit you are probably very happy with dysfunctional government employees like Rubio.
An extra problem is that Chris Christie is so tarnishing Rubio he will be easy to beat in the general if it gets that far which is not likely.

To me how you described your "organization" meeting with other NGOs, the CDC and WHO is this was a either a meeting about a grant proposal, a general funding meeting or a seminar for already funded agencies. The funding for you and other agencies would typically be the government. Hence you are a government employee replete with all the bad habits.

We are privately funded and are not controlled by any federal government agency. We do however often advise and assist them. Trust me, they need the help.

It could be that you are funded by a foundation that in itself for certain programs is funded by the government. Nevertheless, just being part of the network fosters exposure and the inertia created by bureaucracy is contagious.
