Republican Bevin wins Kentucky governor race

Republican Matt Bevin, a businessman and Tea Party favorite, beat Democrat Jack Conway on Tuesday to win the race for Kentucky governor -- becoming only the second GOP governor in the state in four decades.

The off-year election, one of many state and local contests held Tuesday ?across the country, was seen by some as a test for outsider candidates at a time when several such candidates are seeking the GOP presidential nomination. Bevin, who has run as an outsider ever since he unsuccessfully challenged Sen. Mitch McConnell last year, was declared the winner over state Attorney General Conway in the gubernatorial race shortly after polls closed Tuesday evening.
Independent Drew Curtis was a distant third in Tuesday's election.

?The office is currently held by a Democrat. Bevin's election gives Republicans control of the state's executive branch along with a commanding majority in the state Senate. Democrats still have an eight-seat majority in the state House of Representatives.

Throughout his campaign, Bevin cast himself as an outsider, in both government and politics. The 48-year-old investment manager has never held public office and was shunned by the state's Republican political establishment when he challenged McConnell in the 2014 Senate primary. He never took any meaningful steps to repair those relationships after the race, often deflecting assistance from party officials and likely affecting his fundraising ability.
He relied more on the details of his personal story — his Christian faith and his four adopted children from Ethiopia — than his political policies.

Bevin's campaign was mostly self-funded, and he preferred to speak to small gatherings of voters instead of courting influential donors. His running mate, Jenean Hampton, is a retired Air Force officer who moved to Kentucky from Detroit and whose only political experience is a lopsided loss to the former speaker of the Kentucky House of Representatives in 2014. Now, Hampton will become the first black person to ever hold statewide office in Kentucky.

Conway conceded the race shortly before 9 p.m. at the Frankfort Convention Center, telling the quiet crowd it was not the result he had hoped for, "but it is the result we respect." He said he called Bevin and wished him well.

"It was a cordial phone call. I told him I remain positive about moving this state forward, and if he ever needed any assistance, this Democrat was at his disposal," Conway said.
Bevin ran an aggressive campaign, often arguing with reporters and even dropping by the state Democratic Party headquarters, twice, to argue with them about their signs criticizing him as dishonest. But it appeared Bevin was able to tap into voters' growing frustration with their government to overcome any concerns they may have had about his temperament. He has promised some sweeping changes, most notably repealing the state's expanded Medicaid program and kynect, the state-run health insurance exchange. Those decisions will affect the health insurance of about a half-million people.

Focus will almost immediately shift to the state House elections in 2016, where McConnell has vowed to flex his powerful fundraising muscle to help Republicans to take over the only Southern state legislative body controlled by Democrats.

The results Tuesday were also a potentially troubling sign for Democrats ahead of next year's presidential election.

Bevin waged a campaign to scale back the state's Medicaid expansion that was made possible by President Obama's health care overhaul. He also played up his support of Kim Davis, the Rowan County clerk jailed for refusing to issue marriage licenses to same-sex couples.

Kicked to the curb: The San Francisco sheriff who put a convicted felon that had been repeatedly deported and shot and killed Kate Steinle back on the street. The soon to be unemployed sheriff cited San Francisco’s illegal sanctuary city ordinance.

Houston voters reject the Democrat’s pro-homosexual ordinance.

Virginia Republicans will continue to control both the State Senate and General Assembly after winning every race yesterday. The Virginia Governor, a Democrat, campaigned hard and backed by hundreds of millions of dollars from the DNC failed to wrest control from the Republicans.

The latest nationwide Quinnipiac poll shows Dr. Ben Carson leading Hillary Clinton for President.

How will repealing the states medicad expansion and getting rid of kynect improve the lives of the people who get there insurance through them? If they lose there insurance wont they have to pay a penalty for not having insurance?

The Obama administration pledged to use any tool available to recoup $1 billion in taxpayer money used to fund 12 insurance startups that have folded.

But getting that money back is easier said than done, experts said.

More than half of the 23 taxpayer-funded Obamacare consumer oriented and operated plans will not offer insurance in 2016. A slew of financial problems that include a lack of federal funding helped doom the co-ops, created to offer more plans on Obamacare marketplaces.
Now attention is shifting to how exactly the administration can recover the more than $1 billion in loans it gave to the 12 that are winding down.

Although experts can't peg how much the administration could get back, Thomas Miller of the right-leaning think tank American Enterprise Institute said he would be shocked if "they lost half of the money or more. That would be a pretty spectacular failure."

One of the issues is the Obama administration isn't the only one looking to get back money.
Courts are expected to liquidate the co-ops' assets to generate money to pay off their creditors. Once that money becomes available, most states have an order of who gets paid first. And usually, the list starts with a fund intended to help cover claims from policyholders.
When an insurer goes under, a guaranty association steps in to make sure the insurer's claims are paid. Every other health insurer in the state contributes to the guaranty association's fund.

CoOportunity Health, an insurer that served Iowa and Nebraska, may provide clues for what to expect for recouping lost loans.

The co-op, which received $147 million in federal loans, shut down in December 2014 because it did not have enough money to cover its insurance claims. Its assets were liquidated in February.

Iowa and Nebraska guaranty associations paid out $109 million in claims to healthcare providers, according to a recent report filed with the court handling the co-op's finances.
The liquidator is awaiting word on whether the co-op will get more federal funds before doling out the liquidated assets, a spokesman with Iowa's insurance regulator said.

CoOportunity could still get some money from federal risk-sharing programs.

Iowa has an order for whom gets paid first, starting with covering the cost and expenses of the liquidation. The federal government is third on the list.

There is another wrinkle that the federal government faces, and it comes in the form of surplus notes.

A surplus note is similar to a bond. The note is not counted as debt on a company's ledger, but it can be paid only with explicit regulatory approval, said Kevin Fitzgerald, a partner with the law firm Foley & Lardner.

The federal government allowed seven co-ops to convert their solvency or startup loans to surplus notes, which let them record the loans as equity. That helped the co-ops satisfy solvency requirements from the Centers for Medicare and Medicaid Services, which oversees the plans.

The co-ops were in Arizona, Michigan, Oregon, Colorado, New Mexico, Connecticut and Wisconsin. Co-ops in Oregon, Michigan, Colorado and Arizona have shut down.

A major problem is that surplus notes are often at the bottom of the list when creditors are paid out after an insurer is liquidated.

For example, in Iowa, the federal government is third on the list but surplus notes are eighth.
Republicans during a Tuesday hearing criticized the administration for the surplus notes, which made the co-ops look more attractive financially than they actually were.

"This is basically an accounting trick," said Rep. Lynn Jenkins, R-Kan., during a hearing of the House Ways and Means Committee's health subcommittee.

CMS refused to comment further on the co-ops beyond the testimony of administration official Mandy Cohen at the Tuesday hearing.

The agency "takes its oversight of taxpayer funds seriously," she said in her prepared testimony.

Another co-op hearing, in the House Energy and Commerce Committee's oversight subcommittee, will be held Thursday.
