FBI Director James Comey confirmed Monday that the law prohibiting the private email server being used for official government business has been in place since 2009.

I'm just glad to be a spectator in this one.
It is coming down to an Obama administration vs. Hillary deal.

At least Bernie Sanders is smiling.

That may be true, but the private server is the least of her problems now. What was ON the server, for instance....Classified documents, top secret items and what not. Plus, now that the
server has been tampered with, obstruction of justice enters into the picture. Not to mention
who may have hacked the unsecure server at her home. Her susceptibility to blackmail makes
her unfit to serve.

An opinion piece from USAToday:

Fact-checking Hillary: Column
James S. Robbins 8:13 p.m. EDT August 13, 2015

Clinton convicted herself with a multitude of misleading and error-riddled email apologies.

The storied private server that then-Secretary of State Hillary Clinton used for her work email as the nation’s top diplomat is now in the hands of the FBI. It seems inevitable after so many months of controversy.

Whatever information comes out of the investigation, the tide of events that got us here has tested the Democratic presidential candidate’s credibility. It began with her first public statement on the matter five months ago at the United Nations.

At the time she said, “I opted for convenience to use my personal email account … because I thought it would be easier to carry just one device for my work and for my personal emails instead of two.”

Even then it was hard to understand how operating and maintaining a home-based email server was more convenient than using the system provided by the State Department. But her convenience claim couldn’t stand up to the slightest scrutiny. Her own words from a month before in Silicon Valley directly contradicted the claim. She told the audience that she now used an iPhone, a BlackBerry, an iPad and a mini iPad — convenient.

Many of Clinton’s other claims in March have not aged well, either:

With respect to her server’s security, Clinton said “the system we used was set up for President Clinton’s office. And it had numerous safeguards. It was on property guarded by the Secret Service. And there were no security breaches." Later in the news conference, she said even more clearly, “The use of that server ... started with my husband.

Now we know differently. The system set up for the former president was deemed inadequate to the needs of a secretary of State, so a new server was set up. We know that in the first three months of her term, “access to the server was not encrypted or authenticated with a digital certificate,” the most basic type of security, according to cyber security firm Venafi.

And we don’t really know whether there were any security breaches. The FBI is only now looking into the setup at Denver's Platte River Networks, which handled some elements of Clinton’s digital communications. A 2014 report from the National Security Agency noted that Chinese hackers had been actively targeting the private email accounts of U.S. government officials since 2010.

Clinton said at the news conference that she had provided “all my emails that could possibly be work-related.” There was no equivocation, she said again, “I have absolute confidence that everything that could be in any way connected to work is now in the possession of the State Department.”

We already know that while in office, she was communicating with a former political aide to her husband, Sidney Blumenthal, (who was rejected for a State Department job under Secretary Clinton) about foreign issues through personal email, and that she did not turn over all of those conversations to the State Department.

One reason Clinton said she was so confident all the work email was in the State Department’s hands is because it always had been. “It was my practice,” she said, “to communicate with State Department and other government officials on their .gov accounts so those emails would be automatically saved in the State Department system.”

But that is not true either. We now know that Huma Abedein, one of Clinton’s most trusted aides, also had an email account on Secretary Clinton’s home server. Email between their two accounts would be archived at the State Department only if a third email account at a state.gov address was part of the conversation.

A recitation of the other false, misleading or conveniently incomplete statements in Clinton’s original news conference could go on for far longer than anyone would like to think. Her claim that her adherence to the rules was “undisputed”; her claim that “there is no classified material”; her assertion of “unprecedented” transparency; and her claim that all she did in disposing of “personal” emails is just what any other State Department employee could do — all are now disputed.

As the FBI takes control of the server at the center of the credibility questions and begins the first independent analysis of the facts, there is little reason to believe that Hillary Clinton’s original version of events will hold up to deeper scrutiny.

The fact is that the two emails were already classified as Top Secret and the other two were also Classified.

The State Department is playing fast with the truth in their effort to cover for Hillary.
This is also one of the sources of The Intelligence Communities now public fight with The State Department’s non-cooperation in the investigation.

These four emails are taken from a random sampling of 40 emails. If the pattern of 10% holds there could be many hundreds of Classified documents on Hillary’s illegal private email server.

Since Muleman is allergic to facts and research, I'll post this link to his favorite site so he and alloak can ignore it and continue to be misinformed. 😛

http://mediamatters.org/research/2015/08/14/more-myths-and-facts-on-top-secret-materials-in/204946

The officials who spoke to the AP on condition of anonymity work in intelligence and other agencies. They wouldn't detail the contents of the emails because of ongoing questions about classification level. Clinton did not transmit the sensitive information herself, they said, and nothing in the emails she received makes clear reference to communications intercepts, confidential intelligence methods or any other form of sensitive sourcing.

The drone exchange, the officials said, begins with a copy of a news article that discusses the CIA drone program that targets terrorists in Pakistan and elsewhere. While a secret program, it is well-known and often reported on. The copy makes reference to classified information, and a Clinton adviser follows up by dancing around a top secret in a way that could possibly be inferred as confirmation, they said. Several officials, however, described this claim as tenuous.

But a second email reviewed by Charles McCullough, the intelligence community inspector general, appears more suspect. Nothing in the message is "lifted" from classified documents, the officials said, though they differed on where the information in it was sourced. Some said it improperly points back to highly classified material, while others countered that it was a classic case of what the government calls "parallel reporting" - different people knowing the same thing through different means. [Associated Press, 8/14/15]

and this:

MYTH: The FBI "Seized" Clinton's Private Email Server

Fox's Kelly File: "FBI Seizes Private Clinton Email Server." In a August 13 report on Fox's The Kelly File, substitute host Shannon Bream opened a segment by stating, "Breaking tonight, new questions after the FBI seizes the private email server that Hillary Clinton used as secretary of state, investigators taking possession of the server from a New Jersey data center."

[Fox News, The Kelly File, 8/13/15, via Nexis]

FACT: Clinton Voluntarily Turned Over Email Server

ABC News: "The Server Was Handed Over Voluntarily." On August 12, Hillary Clinton's team arranged for the technology company Platte River Networks, which managed her email system previously, to give her private email server to the FBI. ABC News reported that the server "was handed over voluntarily" and was transferred "with no subpoena." From the article:

Barbara Wells, a lawyer for Platte River Networks, the technology company that has managed Clinton's email server since 2013, said the company turned the server over to the FBI Wednesday afternoon at a New Jersey facility.

She said the server was handed over voluntarily, under an agreement between Platte River and Clinton's presidential campaign, with no subpoena. [ABC News, 8/13/15]

How can someone so concerned about lying defend Hillary Clinton?

That's just flat-out weird.

This is getting better every day.

Obama cannot allow the truth of the Benghazi fiasco become public. That would destroy his presidency and expose the lies he told just prior to the 2012 election and prove his foreign policy incompetence.

Hillary is in deep trouble and will be facing felonies and treason charges. So, is she going to Martha’s Vineyard to beg for a plea bargain or a pardon?

Clinton, Obama to meet face to face on Martha's Vineyard amid email controversy, Biden chatter
Published August 15, 2015

President Obama and Democratic presidential candidate Hillary Clinton will meet face to face Saturday evening on Martha's Vineyard, amid increasing scrutiny about Clinton's activities as secretary of state and speculation about whether Vice President Biden will challenge her in 2016.

Clinton and Obama will meet on the same exclusive Massachusetts vacation island on which they met last August under strained circumstances. They plan to attend the 80th birthday party for Vernon Jordan, a Democratic operative and former Clinton administration adviser.
The swanky Massachusetts island is a famous as a gathering spot for prominent Democratic figures.

Clinton will join Obama, who is vacationing on the island with his family, along with a number of big-name corporate, civil rights and other political leaders.

Last year before they met, Clinton criticized the administration’s foreign policy, arguing in a story in The Atlantic that failing to arm Syrian rebels against the regime of Syria’s Bashar al Assad's could have contributed to the rise of radical Islamic groups in Syria and Iraq.
She called Obama a day before they met at a private party on the Vineyard and told reporters she would "absolutely" hug it out with the president.

This year, Clinton's use of a private server and email accounts while she was secretary of state from 2009 to 2013 has become an increasing concern. She turned over roughly 55,000 pages of emails but deleted thousands of others she deemed personal.

Clinton has recently turned over the server to the State Department, and the FBI is now investigating how classified information from the agency reached the server.
The front running Clinton’s poll numbers, including those about her trustworthiness among voters, have declined in recent weeks as the email controversy appears to grow, which has created speculation about whether Biden will launch another presidential bid.

Clinton will go the island after speaking Saturday afternoon at the Iowa State Fair.

She and husband Bill Clinton, a former president, are scheduled to vacation in the Hamptons, a New York vacation spot also popular with the wealthy and famous, in the last two weeks of August.

Biden running could create a politically awkward situation for Obama, though he is not expected to endorse a candidate in the party primary.

Biden supporters are reportedly already looking at a possible campaign and fundraising potential.

Obama and his family vacation almost every August on Martha's Vineyard, and he's been spending most of this year's two-week trip on the golf course, at the beach and dining at the island's upscale restaurants. Obama returns to Washington on Aug. 23.

The Associated Press contributes to this report.

Note to Hillary: your presidential campaign is over.

Hillary got pounded at The Iowa State Fair today by people wanting her to come clean about her email scandal.

In her true politician pant-suit manner, Hillary has changed her standard response.

In the 1980s amid all her and her husband’s scandals Hillary used the “It is the vast right-wing conspiracy” line.

Now she has started using “this is just the political game the GOP plays”.

Tragically most people know that The GOP had anything to do with any of her many scandals.
Each has been self-inflicted.

yesterday in iowa Hillary said she never sent or received classified documents on the private server. How could she do her job as secretary of state if she didn't send or receive classified documents? She's either lying or didn't do her job. Which is it?

State Dept. uncovers nearly 18,000 missing emails sought from ex-Clinton spokesman

By Sarah Westwood - Published August 17, 2015

Why Clinton's e-mail saga has echoes of Watergate

State Department officials have uncovered 17,855 emails sent between a former Hillary Clinton spokesman and reporters that the agency long claimed did not exist.

The trove was among more than 80,000 emails belonging to Philippe Reines, a Clinton aide, that were discovered on his State Department account, officials said in court filings Aug. 13.

In response to a Freedom of Information Act request filed by Gawker Media in 2013, the State Department said it had no responsive records. Gawker was seeking official correspondence between Reines and reporters from 33 news outlets.

But State officials responded Thursday with the news that they had inexplicably found 81,159 emails on Reines' ".gov" email account despite asserting two years ago that none existed. Twenty-two percent, or 17,855, of the emails were likely related to Gawker's request.

Ah, those pesky details!

Our friends seem to have a hard time with exactly how the process actually works.

Hillary does have some serious legal problem and her campaign is showing panic.
The major legitimate polls all show her at the bottom when it comes to trust.
In New Hampshire she is down 7 points to Bernie the socialist.

The Democratic Party is also having a fit. Key Democrats are dropping names like John Kerry, Al Gore and others to gauge media reaction. We’ll just have to wait for other luminaries such as Howard Dean, John Edwards and Michael Dukakis.

Of course polls at this point are more about name recognition than anything else.

We will begin to see clarity after March 1st.
If The F.B.I. and The Justice Department do its jobs Hillary won’t be around.

Democratic rep: Clinton email flap 'could upend her campaign'

By Nick Gass - 8/20/15 8:03 AM EDT

In what appears to be the sharpest criticism of Hillary Clinton’s email scandal yet from a Democratic member of Congress, Kentucky Rep. John Yarmuth said in an interview with local television on Wednesday that it is possible that the issue “could upend her campaign.”

“I just never feel I have a grasp of what the facts are,” the five-term Democratic lawmaker told Louisville’s ABC affiliate on Wednesday. “Clearly, she has handled it poorly from the first day. And, there’s the appearance of dishonesty, if it’s not dishonest.”

If Clinton “intentionally misled or lied to the American people” and knowingly broke federal rules by transmitting classified information through her private email server, “then I think she has disqualified herself,” said Yarmuth, the only Democrat in the Bluegrass State’s delegation.

At the same time, he told the station, the situation could blow over if the former secretary of state is telling the truth because it is still early on in the campaign.

Yarmuth, who has not endorsed Clinton, said he still thinks that she will be the Democratic nominee next year.

Apparently Hillary Obama and State Department violated a Golden Rule: Don’t piss-off the Judge:

Judge orders State Dept. to work on recovering emails, suggests Clinton violated policy
By Jason Donner - Published August 20, 2015 - FoxNews.com

State Dept. says Clinton did not use gov't-issued BlackBerry

WASHINGTON – A federal judge, appointed to the bench by former President Bill Clinton, ordered the State Department on Thursday to work with the FBI to determine if any of Hillary Clinton’s emails on her server during her tenure as secretary of state could be recovered.

“We wouldn’t be here today if this employee had followed government policy,” U.S. District Judge Emmet Sullivan said, in an apparent reference to Clinton.

The hearing, which lasted nearly 90 minutes, was part of another case brought by Judicial Watch seeking records on Clinton's emails and her aide Huma Abedin’s outside employment while she worked at the State Department.

Clinton, a 2016 Democratic candidate for president, has long maintained her practice of using a private email server fell within government regulations. She has handed over 30,000 emails to her former employer but did not turn over 31,000 other emails she said were personal.

Sullivan pressed DOJ lawyers on whether the State Department had done enough to comply with the public records laws by combing through the emails Clinton had provided but not the others she said were personal.

Judicial Watch, a conservative watchdog group, has repeatedly alleged that the State Department failed to comply with Freedom of Information requests and has purposely slow walked searches and withheld information.

Sullivan said he wanted the State Department to ask Clinton if any third parties had access to copies of the emails.

The judge also said he would not micro-manage the dialogue between the State
Department and the FBI but would leave it up to them to work out the details.

“We’ll see what that investigation brings,” Sullivan said. The State Department has 30 days to comply with Sullivan’s order.

The next hearing has been scheduled for Oct. 1.

The partisan witch hunt victim approach is done. Lying her way out of it fell flat.
Trying to joke her way out of it appears futile.

Eventually Hillary will 1) plead ignorance, or 2) start blaming the whole thing on
staffers. Probably both.

With Hillary Clinton’s long-time henchwoman Cheryl Mills and senior aide Huma Abedin tied directly to the corruption the internal blame game should start soon.

When criminal charges and possible jail time are involved, loyalty and political ideology go right out the window and morph into saving one’s own a$$.

Obama is in a real pickle here. He does not want Hillary to get the nomination and will support Joe Biden solely to further his own political agenda. In the Democratic Party whatever Obama says the followers will do.

However, if cornered Hillary could spill the beans on the Benghazi and Libya fiascos and Obama’s “legacy” would be further trashed.

It doesn’t help that The Clintons and The Obama’s despise each other. See The New York Times Edward Klein book “Blood Feud”.

Whew.
