GD50 tickets a giant bait and switch fraud

Does anyone know how they can get away with this?
>Seating chart and prices were changed within the first weeks after the mail order deadline.
>Santa Clara online ticket lottery had multiple reports of people ordering and paying for the most expensive seats only to receive tickets in the upper levels.
>Now mail order tickets are arriving and there are multiple reports of people who paid $215 per seat receiving seats in the upper decks.
Given the visibility and scale of GD50 my question is what is the recourse here? This thing is just blatantly illegal.

I would think that would have a lot to do with whatever disclaimers were in the fine print.
I'm going to the Santa Clara shows, my buddy won a spot in the lottery and we are upper level behind the stage but that was clear from the get-go.

The parking pass lottery, however, now that's the most complicated of a money grab I think I've ever seen.

The first tip off was you're buying tickets to see "The Grateful Dead".
Be careful what you wish for.
You just might not get it.

No matter what the disclaimers are, you can't enforce and illegal contract and for many reasons, I don't believe making an offer, getting acceptance in the form of payment and then unilaterally changing the terms of the contract to a 115% markup is legal and therefore not enforceable.

could have been a computer error but it would be a tough hash ball to swallow since tickets are scarce. plus, if you are paying without knowing your exact section/seat location than there must be some language that they have the final say on seating.

You can dispute this with your credit card company to get a refund on the ticket price difference or cancel completely but then you either have to accept the nosebleeds or give up the tickets altogether.
You could also take them to small claims or maybe try to do a class action lawsuit but is it worth the effort?

Well, I'm no legal expert, but I would most certainly think disclaimers do matter, but in this case I do not know what they were.

In order to have an enforceable contract you need an 1) Offer + 2) Acceptance For 3) Consideration.
Offer - in this case was the money sent in for the prices and seats listed At The Time The Money Was Sent.
Acceptance - Email from GD Tickets confirming tickets.
Consideration - The money sent for the tickets and seat prices listed at the time the money was sent.
If either party makes a material change to the contract like, say, charging a 115% markup, without the informed consent of the other party the contract is unenforceable because there is no Acceptance of the counteroffer.
That is Contract law 101 and I have to believe there are further laws regarding misrepresenting material facts in ticket sales.
I am sure they know that 1) what they are doing is illegal and 2) the people they have sold this bag of shit to are not going to be motivated enough to do anything about it.
Either way I would expect Peter Shapiro to have a pretty sh*tty reputation among concertgoers when this is all over.

Ok, cool.
Where are you seeing the reports of people who didn't get what they ordered? I'm not doubting you, just curious since I'm going to a couple of the shows.

I can't find any news about ticket bait and switch.

go to the venue for some dumb event a night or so before and hide somewhere and wait for the Dead. bring water and power bars
or show up in some kind of service uniform, paramedic, electrician, and just walk in the back door
or better yet, admit that they suck without Garcia and forget about it

Phantasy Tour - Phish Board and Reddit

I've heard the same rumors too on another board - I bet it's 2nd hand from phantasy tour. . I don't know anyone who has gotten screwed (yet) - tix are just arriving now.
Maybe it's true, but I don't consider PT a reliable source of information
edit: fwiw I didn't see anything about it over at thephilzone

True that, Bhawk are you going to a Giants game when you are there?

Won't have time, no.
For me, this trip is about a whole lot more than just the music. My buddy recently lost his wife after a long illness, we were concert partners for countless shows of all kinds over the years, will be so awesome to see him, plus, by some miracle (pun intended)...there was a group of 7 of us that were at the last Vegas shows in 1995...ended up being the last GD shows for all of us...we are ALL gathering in San Fran, just a little over 20 years later. What a reunion! One of them I haven't seen in person in 17 years.
It's an event and the sights will be something to see. Bob Weir forgetting off-key lyrics doesn't mean jack squat to me. The magic of the Grateful Dead experience for me was the pure joy of communal spirit and I feel very lucky (grateful, even!) that I get one last shot at even a sliver of what it once was.

14 minutes until additional Chicago tickets are released.

So sorry for your friend's loss. An otherwise wonderful summation. Couldn't have said it any better.

Pulled a floor seat for July 3rd than realized I didn't want to pay that much to see them.

Good going Bhawk! Happy Trails Man. May the 4 winds blow you...

This has Shapiro written all over it.
Anyway I hope all of you going have some great shows.
Me?
This weekend I'm working on our boat.
Hopefully next week we're in the water.
Berry and Duane headlining all summer.

Washington Post article on the tickets...

Parking lottery yesterday went smoothly, got tailgating parking passes for both days, $60 per day.
Wait, wait, wait...
$14 service charge (on parking passes), soooooooo...
$74 per day, which is actually more expensive than the face value of our tickets, LOL.
Ain't no money grab like an old hippie money grab... 😛

You can easily make that money back selling blotter art grilled cheese.

I'm going to document this adventure on either Twitter or Instagram or both. Might have to expand the memory on my phone for the lot pictures alone.
