I'm pretty sure the NYC threshhold is face value. There don't seem to be any space restrictions- there are people selling almost right at the door and the police don't seem to bother them...
NYCScammer -- I wasn't suggesting that anyone sell over face value, it just seemed like the police were just going after such scalpers (as they should be). I was more concerned about it being illegal at any price, including below cost.
In Atlanta, it's actually legal to sell at any price, including way above face value. However, it is ABSOLUTELY illegal to sell tickets, even below face, within a certain distance of the venue or a ticketmaster outlet (like 2,000 or 3,000 feet). I was just wondering whether there were similar laws in NYC.
And if your questions were aimed at me, I wasn't cited or arrested or anything last year for scalping. It was just obvious that it was an undercover cop, so it must be illegal at some point. Just curious what that threshhold is (in case it's below face).
I'm pretty sure you can sell tickets for their face plus TM charges and then another small amount on top of that. I'll go to work and check on how much more you can add. Let me say though that any good Peach head would only ask what they paid. You did not say if you got a summons, were arrested or just told to move on. PM me with the details if you don't want to post in the open. It's hard for the cop whose job it is to get the scalpers trying to rip some one off to tell the difference from some one who is trying to do the right thing. Right in front of the theatre is definately a bad spot. Yogi's is much better.

However, one of the times I laughed the loudest ever, a friend and I were donating blood. Some retired older ladies were volunteering asking all the obligatory screening questions.
He was sitting in the chair next to me. When the lady got to the question, "have you ever had sex with a male?" He, spur of the moment, answered, "Human?"

I am not sure about the law but I have never seen anyone get in trouble for selling a ticket for face value in front of the beacon. If you want to be safe, you could go up the street to Yogi's- where there are tons of ABB fans hanging out before the show- and try to sell the tickets there.
For people who want to buy tickets- beware of the scalpers who are obviously not fans and sell bad or stolen tickets. The scalper that sold a friend of mine a stolen ticket three years ago in front of the beacon is still
around and he will be there again this year. I can't wait to say hi to him.

I never had a problem selling my Beacon tix for face value in front of the theater.....until last year. I usually go the first Friday and Saturday nights of the run, and last year I sold a spare Orchestra level ticket toward the back (I believe Row R towards the middle) on the Friday night for just $30. I think I paid closer to $80 with TM charges and fees. While that sounds bad, there were many many many people outside that night unable to sell their spare tickets at all (especially Balcony ticket-holders). Again, in years past I've never had problems getting back what I paid.....maybe last year was just a fluke.
Does anyone know the law in NYC with regards to re-selling tickets? A couple years ago I went with a Manhattan-ite, and he thought it was completely illegal to sell tickets in front of the venue at all.....even at a loss. A cop refused to answer me when I asked. I will say that last year, whatever the law is, they seemed to be just going after scalpers trying to turn a profit. There was one undercover cop (dressed quite obviously as a faux-hippie) who kept walking around asking if anyone had tickets (there were like 15 guys walking around yelling "Who needs a ticket?" ) and if you responded she would ask how much. If you said "face" or ANYTHING under face, she would just walk away. The only reasons I would say that she was undercover, and not just looking for a deal, is b/c she apparently was disinterested in even a $15 ticket, and about every 5 or 10 minutes she would take a break and go hang out with the two uniformed cops at the barricade in front of the venue. That, and again, her hippie get-up looked a bit contrived.
So again, does anyone know the ticket re-selling laws in NYC?

I never had any problems selling tix at the Beacon. Keep the neon signs to a minimum tho.
One thing you should NOT do is "party" outside the Beacon. Quite a strong undercover presence out there. Not lookin' for people selling an extra ticket tho - only those who can't contain themselves before getting inside the Beacon "safehouse".

tkirk, be careful. Different venues may handle it differently, but a freind of mine was banned for life (how do you enforce that?) from Tweeter Center/Great Woods for selling at face valuse on their property. They saw it as a ticket they couldn't sell.

Last year we needed to sell 1 ticket outside the Beacon. My husband was so proud of himself for foiling a scalper. He just watched the scalper and followed him saying "face value", made a fan very happy. My thought was if you were selling at face value it's not really scalping, am I mistaken or is that true? Anybody? :uhoh:
A Happy Birthday to Bro. Tom S., the first member of the extended family I ever met (at his coffee shop in Cullman.)
