Check this out - do a search for "Murder Trial of Charlottesville Driver" EVERY major news outlet on the planet has a current headline on this, EXCEPT Fox. Zero. I have seen Fox pull these blackouts a lot, it is creepy as hell.

Strange that the top death.penalty state of Virginia did not go for execution. Probably because it is a politically charged case. Real weird, since he pleaded Not Guilty - I figured he would get max sentence. My guess is he gets 20 to life in Federal as well, walks in ten for good behavior and positive psych eval, and a court order barring him from driving muscle cars.
So he got a little worked up. Let's keep this case low profile, so as not to create friction among the "good people on both sides".

I was surprised, too, but think that Virginia now requires another felony in addition to murder (like abduction) for the death penalty. I could be wrong.
What I find even more outrageous is that the victim's father didn't think the state should seek the DP since Fields was "too young and stupid to understand his crime."
What's the IQ & age at which people are held accountable? According to Cohen's request for leniency for his sentencing, being 52 with a law degree is premature plus he "loves his kids."
