Earlier this week, the Trump administration said it would expand the number of H-2B visas available nationwide this year by 15,000, using power granted by Congress to go beyond the statutory cap of 66,000 per year. This category of visas are given to foreign workers filling temporary jobs outside the agriculture industry, in fields like construction, fishing and tourism.
Mar-a-Lago is open only during Palm Beach's ritzy winter “season,” when the club's wealthy members arrive from colder climes and the ballrooms are used for charity galas. It has applied for H-2B visas in past years, although this year's request is slightly larger than the one in 2016. That year, Trump's club asked for 64 workers: This year, he is asking for one more cook and five more waiters.
Now, the Labor Department — which reports to Trump — must make decisions that will affect two for-profit business that the president still owns.
The next step, a Department of Labor spokesman said, is that the two clubs must take steps to try to recruit American workers for these jobs. That often involves placing help-wanted ads in local newspapers and contacting former workers. If those efforts are unsuccessful, then Trump's clubs can ask for the Department of Labor to certify that it has tried and failed to hire Americans. After that, the Trump clubs can ask the Department of Homeland Security to issue visas for workers it has found in other countries.
Egan Reich, a spokesman for the Labor Department who is a career employee, wrote in response to inquiries from The Washington Post that "The Department of Labor does not give preference or special treatment to any business or individual.”
Trump built his campaign last year in part on an appeal to American workers angry that their jobs had been taken by immigrants or laborers overseas. In his inaugural address, Trump said that under his leadership the country would “follow two simple rules: buy American, and hire American.”
And this week, Trump has celebrated American companies and American labor, including an event at the White House where the president climbed into the cab of an American-made firetruck. In a proclamation Monday, Trump said he called “upon Americans to pay special tribute to the builders, to the ranchers, to the crafters, and to all those who work every day to make America great.”
Earlier this year, the Trump Winery near Charlottesville, Va., applied for visas to hire 23 foreign workers under a different visa program meant for farm workers.
The Trump Organization did not respond to questions sent by email on Thursday afternoon, asking why American workers could not be found to fill these jobs — and if the company had made any extra efforts this year, in light of Trump's calls to hire American workers.
The Secret Service did not respond to a query asking whether it would have a role in vetting any foreign laborers hired to work in a club that serves, at times, as the president's home.

I am pretty much hardline illegal immigration type, but there is a guest worker program for legal temporary alien workers in place and there is very little wrong with that in my opinion.
Now for Trump, at best the optics are horrible. I just think about how he could totally control some of these narratives if he said he was making his products in the US or his companies were bending over backwards to fill open positions with qualified US citizen workers.
It is true time and time again, supporters say how the media attacks him at every corner, and they do, but as has always been the case, he sets the table perfectly for them. Even with some miracle that it would, there would be some exclusion cause or some justifiable exclusion in his distorted perception of reality for Trump properties, as he doesn't see personal conflicts of interest. He also doesn't believe that that protocol, ethics, & laws apply to his family.

2112, there are different work Visas. The H2B Visa shouldn't be confused with the H1B or H2A. H2B is for temporary workers just like a resort would hire, which is what Mar-a-Lago is seeking, just like Disney might. H1B is the skilled worker permit and H2A is the agricultural worker permit.

I'm sure there are plenty of Americans who could cook, wait tables and clean rooms at these resorts. Importing workers for these jobs takes jobs away from Americans just as illegal workers do. 1.) H-2B visa holders are in the U.S. legally and you cannot prove otherwise.
2.) The Trump organization, just like every other company that applies for H-2B visa workers must first try to hire citizens and provide proof of doing so in their application for H-2B visa workers. The Trump organization did try to hire citizens and provided the Florida Department of Labor the documentation proving that that could not get citizen and thus legally applied for the H-2B visa workers.

Why this is a nothingburger – Those unfamiliar with the South Florida general labor market are most likely unfamiliar with the extreme swings in “seasonal need” workers.
Does the word “Snowbird” ring a bell? Florida has a “tourist season” which runs from (generally speaking) just after Thanksgiving to Easter annually. January, February and March are the peak. The first Monday in February is the absolute peak as almost every time-share and hotel unit flips that week.
The volume of work within the service and hospitality industry doubles during the tourist season, and those businesses who hire within the general labor market struggle to increase their labor in relationship to the increase in business. In addition, local workers looking for employment are reluctant to take temporary or “seasonal” jobs, and prefer longer term -more stable- employment.
Many businesses need to double, or in some cases triple, their workforce in order to meet the business demand. [In 2014 97,300,000 tourists visited Florida].
As a consequence many companies, including Trump owned resorts, have used H-2B visa workers to fill the gap between large fluctuations in business and the needed staffing shortfalls. From my own experience, many of the workers are students from South America (Argentina, Brazil, etc) who take the seasonal jobs Nov/Dec – March/April between their college seasons – and then return home.
In addition you’ll note the dates of the Reuters data:
Trump owns companies that have sought to import at least 1,100 foreign workers on temporary visas since 2000, according to U.S. Department of Labor data reviewed by Reuters. Most of the applications were approved, the data show. (link)
